Like 24 other US states, it is a crime in Michigan for HIV-positive individuals to have sex without first disclosing their HIV-status. In this presentation, I will review findings from a study analyzing 95% of all convictions under the state’s felony HIV disclosure law between 1992 and 2010. I argue that my findings suggest that Michigan’s HIV disclosure law is not intended to promote public health; rather, they suggest a state interest in punishing and controlling the infected.
